Terms of Service

1. Overview

SafeMom, Inc. (“SafeMom,” “we,” “our,” or “us”) operates the SafeMom mobile application (the “App”). By downloading, installing, registering for, accessing, or using the App, you (“User,” “you,” or “your”) agree to be bound by these Terms and by our Privacy Policy. If you do not accept every provision of these Terms, you must not access or use the App.  We may update or amend these Terms at any time by posting an updated version in‑App; continued use of the App after changes are posted constitutes acceptance of the revised Terms. 

2. Eligibility

You must (a) be at least the age of majority in your jurisdiction, or have a parent/guardian’s consent; and (b) have the legal capacity to enter a binding contract. You represent that all information you provide to SafeMom is accurate and complete. 

3. App Purpose & Medical‑Advice Disclaimer

SafeMom lets users photograph or upload product images to identify ingredients that may be unsafe during pregnancy. SafeMom provides informational, “directional” guidance only and does not constitute professional medical advice, diagnosis, or treatment. Always consult your physician or other qualified health‑care provider. Reliance on any App content is solely at your own risk.

4. No‑Lawsuit / Assumption of Risk

To the fullest extent permitted by law, you irrevocably waive, release, and covenant not to sue SafeMom, its parents, subsidiaries, affiliates, officers, directors, employees, and agents for any and all claims, demands, causes of action, damages, losses, or expenses arising out of or related to your access to or use of the App or any information provided therein.

5. User Conduct & Prohibited Uses

You agree not to:

  1. Use the App for any unlawful, fraudulent, or malicious purpose;
  2. Upload content that infringes third‑party rights or contains malware;
  3. Reverse‑engineer, decompile, or otherwise exploit the App except as expressly permitted;
  4. Violate any applicable laws or regulations.
    Violation may result in immediate termination of your access.

6. Subscriptions, Billing & Cancellation

SafeMom is offered on a weekly subscription basis (currently $1.99/week for Standard and $3.99/week for Plus). Prices may change with reasonable advance notice. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Cancellation and refund handling are managed through the platform operator (Apple App Store or Google Play Store).

7. Content Ownership & License

All intellectual‑property rights in the App and its content (software, text, graphics, etc.) belong to SafeMom or its licensors. Subject to your compliance with these Terms, SafeMom grants you a limited, non‑exclusive, revocable, non‑transferable license to use the App for personal, non‑commercial purposes.

8. Third‑Party Content & Links

Third‑party links or ingredient databases may appear in the App. SafeMom does not endorse and is not responsible or liable for third‑party content, products, or services. 

9. Disclaimer of Warranties

THE APP AND ALL INFORMATION PROVIDED ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR ACCURACY. SAFE­MOM DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR‑FREE, OR FREE OF HARMFUL COMPONENTS. 

10. Limitation of Liability

IN NO EVENT SHALL SAFEMOM OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. SAFE­MOM’S TOTAL CUMULATIVE LIABILITY TO YOU FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNTS YOU ACTUALLY PAID TO SAFE­MOM FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. 

11. Indemnification

You agree to indemnify, defend, and hold harmless SafeMom and its affiliates, officers, directors, employees, and agents from any claim, liability, damages, expenses, and costs (including reasonable attorneys’ fees) arising out of or related to your (a) breach of these Terms, (b) misuse of the App, or (c) violation of any law or third‑party right.

12. Termination

SafeMom may suspend or terminate your access to the App at any time, with or without notice, for conduct that SafeMom reasonably believes violates these Terms or is otherwise harmful to other users or SafeMom. Sections intended to survive (including disclaimers, limitations of liability, and indemnities) will do so.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict‑of‑law principles. Any dispute that cannot be resolved informally will be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules; judgment on the award may be entered in any court of competent jurisdiction.

14. Severability

If any provision of these Terms is held unenforceable, that provision will be modified to reflect the parties’ intention, or severed to the extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with any documents expressly referenced herein (including the Privacy Policy), constitute the entire agreement between you and SafeMom regarding the App and supersede all prior agreements or understandings.

16. Changes to Terms

We may revise these Terms at any time by posting an updated version in the App or on our website. Material changes will be communicated via in‑App notice or email. Continued use after changes take effect constitutes your acceptance.
